Terms of Use

These Terms of Use ("Terms") govern your use of the Paint Fun – Color by Numbers app (the "App") developed by Enoshima Game ("we", "us", or "our"). By downloading or using the App, you agree to be bound by these Terms. Please read them carefully before use.

I. Who Can Use the App

You must be at least 13 years of age to download, access, or use the App. If you are a minor who meets this minimum age, a parent or guardian must supervise your use. By using the App, you confirm that you meet this age requirement and have the legal capacity to agree to these Terms.

II. What You Can and Cannot Do

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App for your own non-commercial enjoyment. This license does not give you ownership of the App or any of its content.

You agree not to do any of the following:

Copy, modify, or distribute any part of the App or its content without our permission
Attempt to extract or reverse engineer the source code of the App
Create derivative works or translated versions of the App
Use the App to build a competing product or service
Jailbreak or root your device for use with the App, as doing so may compromise your security and cause the App to stop working
Remove or tamper with any copyright, trademark, or other proprietary notices within the App

All trademarks, intellectual property rights, and content within the App remain the exclusive property of Enoshima Game and its licensors.

III. Purchases and Payments

One-time purchases and subscriptions. Some features may require a one-time purchase or a subscription. Subscriptions are available on various billing cycles (weekly, monthly, tri-monthly, semi-annual, or annual) and will renew automatically unless cancelled:

On the Apple App Store: cancel at least 24 hours before the end of the current period
On the Google Play Store: cancel at any time before the end of the current period

You can manage or cancel your subscription through your account settings at any time. Cancellation takes effect at the end of the current billing period.

Free trials. Some subscriptions may start with a free trial. To avoid being charged, you must cancel before the free trial ends:

On the Apple App Store: at least 24 hours before the trial ends
On the Google Play Store: at any time before the trial ends

EU / EEA residents. By completing a purchase, you agree that digital content is made available immediately and acknowledge that you waive your statutory 14-day right of withdrawal.

We will always make the cost of any paid feature clear to you before you commit to a purchase. We reserve the right to change pricing at any time.

IV. Internet Connectivity and Charges

Some features of the App require an active internet connection. We are not responsible if the App does not function correctly due to a lack of Wi-Fi or mobile data access.

If you use the App over a mobile data connection, your network provider's charges will apply — including potential roaming charges if you use the App outside your home region. You are solely responsible for these costs. If you are not the account holder for the device, we assume you have obtained permission from the account holder before incurring any charges.

Please also make sure your device is adequately charged. We are not liable for any disruption to your use of the App caused by a device running out of battery.

V. Third-Party Services

The App integrates with the following third-party services, which have their own terms and privacy policies:

Google Play Services
AdMob
Unity
AppLovin
Facebook (Meta)

We do not control these third parties and are not responsible for their practices. We encourage you to review their respective policies.

These images are used in accordance with the terms of the Unsplash License, and all rights remain with the original photographers and/or Unsplash. VI. Updates and Availability

We may update, modify, or discontinue the App at any time without prior notice. Some updates may be required for the App to continue working correctly, and you agree to install them when prompted. We do not guarantee that the App will always be compatible with your device's operating system.

We also reserve the right to stop providing the App entirely. If this happens, we may terminate your access without prior notice, at which point your license to use the App will end and you should delete it from your device.

VII. Disclaimers and Liability

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE APP WILL BE AVAILABLE AT ALL TIMES, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE RELY ON THIRD PARTIES TO PROVIDE CERTAIN CONTENT AND INFORMATION WITHIN THE APP, AND WE ACCEPT NO LIABILITY FOR ANY LOSS YOU EXPERIENCE AS A RESULT OF RELYING ON SUCH CONTENT.

TO THE FULLEST EXTENT PERMITTED BY LAW, ENOSHIMA GAME WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability, so the above may not fully apply to you.

VIII. Governing Law

These Terms are governed by and construed in accordance with the laws of Japan, without giving effect to any choice or conflict of law provision or rule. We make no representations that the App is appropriate or available for use in all locations. Those who access or use the App from other jurisdictions do so at their own volition and are responsible for compliance with local law.

IX. Indemnification

You agree to indemnify and hold Enoshima Game (and its officers, employees, and agents) harmless from any claim, demand, loss, or expense — including reasonable attorneys' fees — made by any third party arising out of or relating to (a) your use of the App, (b) your violation of these Terms, or (c) your violation of any applicable law or regulation. We reserve the right, at your expense, to assume the exclusive defense of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of such claims.

X. General

Severability. If any provision of these Terms is found to be invalid or unenforceable under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, and all other provisions will remain in full force and effect.

Entire Agreement. These Terms constitute the entire agreement between you and Enoshima Game regarding your use of the App and supersede any prior agreements between us on the same subject. Your rights under these Terms may not be assigned or transferred without our prior written consent. We may freely assign these Terms.

Waiver. Our failure to enforce any provision of these Terms will not be considered a waiver of that right. Any waiver must be made in writing to be effective.

XI. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the revised version on this page with an updated date. Your continued use of the App after any changes are posted means you accept the updated Terms.
